Editor's Note: The following is a news release from the Minnesota Valley Transit Authority.

The Minnesota Valley Transit Authority (MVTA) has scheduled two public meetings to receive input on proposed service changes to MVTA Routes in conjunction with the opening of the METRO Red Line service in Spring of 2013.

The meetings are scheduled on Thursday, Jan. 10 from 5-7 p.m. in the Eagan Community Room at Eagan City Hall and on Wednesday, Jan. 16 from 5-7 p.m. in the Regent Room at Apple Valley City Hall.  There will be information regarding MVTA’s current routes and proposed changes to local routes that operate on or feed to Cedar Avenue (Routes 420, 437, 438, 440, 441, 442, 444, 445 and 475). Brief presentations will be offered each evening at 5:30 and 6:15 p.m. Otherwise, the meetings will follow an Open House format.

Additionally, there will be a public hearing on the Regional Title VI policies at the Dakota County Library—Burnhaven Branch on Thursday, Feb. 7 from 6-7:30 p.m. Title VI of the Civil Rights Act of 1964, states: “no person in the United States shall, on the ground of race, color or national origin, be excluded from participation in, denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.”  This is part of a series of regional meetings that the Metropolitan Council is offering on proposed policies related to “major service change,” “disparate impact,” and “disproportionate burden.” The MVTA is monitoring the policies being drafted by the Metropolitan Council and is expected to adopt comparable policies at its March Board meeting.

The MVTA is the public transportation provider for the businesses and residents of Apple Valley, Burnsville, Eagan, Rosemount and Savage, and provides service to the Lakeville Cedar Park & Ride.

Sen. Al Franken came to Eagan’s Dakota Hills Middle School this afternoon to discuss school safety protocols with counselors, safety experts and ISD 196 administrators in the wake of last month’s Newtown shootings.

Franken repeatedly emphasized the importance of early treatment of mental illness and also spoke about lockdown drills and perimeter security in remarks to reporters after the meeting.

“You [need to] catch this kind of mental illness early, treat it, so it doesn’t grow into something where you have somebody who becomes a shooter,” he said.

ISD 196 superintendent Jane Berenz; the district’s safety director, Mark Parr; and Dakota Hills Middle principal Trevor Johnson were among the 12 participants in the closed-door roundtable discussion.

“We’re continually reviewing our school safety and security policies,” Parr said. “When we have tragic events like this it gives us another opportunity to discuss those.”

Dakota County Sheriff Dave Bellows said Friday that he supports a ban on the sale of high-capacity assault weapons. Franken said today that it was reasonable to look at banning what he called “essentially military weapons.”

“I don’t think there’s any reason to have 30 rounds in a gun clip,” Franken said. “You’ll remember that the shooter in Tucson was stopped when he went to change clips.”

On Saturday, Franken met with state officials, mental health advocates and members of law enforcement and discussed a partnership between the state’s mental health and criminal justice systems.

“In the aftermath of Sandy Hook, we heard a lot of people talk about mental health," he said Saturday, according to Minnesota Public Radio. "But in some ways, I felt it was unfortunately just kind of a talking point.”                           

Today, in response to a question about whether he would support building a federal database for people with mental health issues, Franken hedged and said he wanted to be careful to keep health and school records separate.

But he said he supported a tighter integration between mental health records and a national background check database.

“The database that is used for background checks is woefully inadequate,” Franken said. “Only 12 out of 50 states send their health records to this database.”

Bellows has said that Minnesota’s permit-to-carry law allows some people with serious mental health issues to acquire firearms.

The article prompted a heated online discussion, with several commenters vigorously opposed to the sheriff's statements. One commenter, identified as Patrick Lynch, called for the election of a new sheriff; another, Jim Christian, said Bellows' response was "reasoned" and "multi-faceted."

Learning Checkpoints to Help District 196 Students With College, Careers

Graduating from high school is a significant milestone in every person's life. It represents the culmination of an E-12 career made up of countless memories, incredible people and significant achievements along each child's path. By the time they reach graduation, all District 196 students should be prepared to continue their education or pursue a career. College and career ready. That is the hope of every parent and our goal for every child. It is the product of what we do.

As parents, it is natural to chart our children's progress year-to-year, grade-to-grade, school picture-to-school picture. More important, though, are the critical learning checkpoints students encounter along the way. For example, how well are students reading by the time they reach third grade? This statewide requirement was added by the Legislature last year. Students who meet and exceed the standard pass this learning checkpoint and are on track with their reading skills. Those who fall short receive timely and focused academic interventions to hone the reading skills they will need to be successful. These students keep moving forward, but with assistance and instruction focused on their specific literacy needs. Calendar changes being implemented this year are giving teachers more time on a regular basis to intervene with students having difficulty, review assessment data and adjust their instruction based on the data and what it says about each student's needs.

The learning checkpoints already exist; the task is identifying the right combination to focus on. Before each child enters kindergarten they must complete a required preschool screening and, beginning this year, they take a summer literacy assessment administered by their teacher. At the other end of the timeline, high school students take state tests in reading and writing that require a passing score to graduate. In the years between, there are many more of these measures that could serve as learning checkpoints to determine if students are on track with particular skills throughout their E-12 career.

As a district, we have begun the process of identifying the skills needed at each level to ensure we are preparing graduates who are college and career ready. Once we pinpoint these along the timeline, we will review the measures already being used and determine which are the best indicators of future success. These will become our learning checkpoints to ensuring college and career-ready graduates in District 196.

Our renewed focus on ensuring college and career-ready graduates grew out of the strategic planning process that a group of 60 district citizens, School Board members and staff underwent in summer 2011. This group reviewed where the district had been and where we were at, but more importantly we discussed where our district needed to be headed in order to ensure high levels of learning, opportunity and expectation at every school, in every classroom, with every student. As a result, our work is focused on the four strategic areas of teaching and learning, early education, educational equity and partnerships. The process of identifying and then implementing our learning checkpoints will likely touch all four strategic areas. We will keep you posted on our progress.

Pet of the Week: Annie Loves Kids, Bare Toes, Obedience School

Editor's note: This is a weekly series called "Pet of the Week" where we feature a companion up for adoption from Dakota County animal rescues.

Annie is a blend of redbone coon hound and pit bull. Her mix of breeds resulted in a beautiful, smart, loving dog who was rescued from a high-kill shelter at the last possible moment.

She came to us with ribs and hip bones showing at 34 pounds at 10 months of age. After some good groceries, she now weighs 50 pounds which is full grown.

Annie would make her a great running partner and she loves kids. Aside from sleeping on her back with all four feet in the air, she loves to play with the resident dog. Games of chase at full speed around the yard, keep my toy away and tossing a ball in the air for catch makes for an entertaining canine. When she isn't racing around with her buddy, she likes to sit in the back yard watching the tops of the trees for squirrels. When the chipmunks chirp, she can leap and jump just like a white-tailed deer.

She is great with kids, loves to lick bare toes and tolerates cats. Annie loves going for long walks and playing at the dog park. She would do best in a fenced in yard and having another playful canine would be wonderful for her.

Currently Annie is going to obedience training classes with her foster mom and she loves the chance to show how smart she is. Annie would enjoy doggie day care as well.

2 Apple Valley Men Arrested in Separate Incidents Involving Loaded Guns

New Year’s Eve wasn’t much of a party for Apple Valley police, who responded to two separate incidents involving loaded guns within 14 hours – one in which they say the suspect threatened to “eat the face off” a paramedic, and another in which a man is accused of waving around a loaded gun at a party.

In the first incident, Craig John Ehrnreiter, 43, who lives in the 4700 block of 137th Circle West, was charged with two felony counts of making terroristic threats, each of which carries a maximum penalty of five years in prison and a $10,000 fine, and one count of child endangerment involving access to a loaded firearm, a gross misdemeanor with a maximum penalty of a year in jail and a $3,000 fine.

In the second incident, Michael Francis Hermanowski, 36, who lives in the 5100 block of 148th Path, was charged with felony second-degree assault with a dangerous weapon, which has a maximum penalty of seven years in prison and a $14,000 fine, and interference with an emergency call, a gross misdemeanor for which the maximum penalty is a year in jail and a $3,000 fine.

Apple Valley police responded to Ehrnreiter’s home just after noon Dec. 31 to check on the welfare of a woman who lived in the home, according to the criminal complaint. An acquaintance of the family told police that Ehnreiter had threatened to kill the woman, that he had a number of firearms in the home and that he had given the woman a half-hour deadline for something.

When police arrived, they heard loud music coming from the home, but no one answered the door to repeated knocks and doorbell ringing. They learned that the woman and her two daughters, ages 10 and 12, had left the residence.

The woman returned shortly afterward, and told police that she had taken the children to a relative’s home earlier in the day because she didn’t feel safe with Ehrnreiter, who had become addicted to prescription painkillers but had run out of them the week before.

The woman said that since he ran out of painkillers, he had been drinking to the point of intoxication. Police said she appeared frightened, and told them that Ehrnreiter had three handguns inside the house and possibly two long guns.

Authorities set up a perimeter around the house and used a public address system to order Ehrnreiter outside. He refused to come out, and called the woman on her cell phone instead, according to the complaint.

An officer answered the call and told Ehnreiter to come outside. He walked out wearing only boxer shorts and a T-shirt.

Officers ordered him to lie on the ground, but when he continued walking quickly toward police, they used a stun gun to subdue him.

Ehrnreiter was put into an ambulance, where he told police that he had several firearms in his house to prepare for the Mayan calendar apocalypse, according to the complaint. He also told a paramedic that he would kill him and “eat his face off,” the complaint charges.

The woman later told police that she and Ehrnreiter had argued that morning. During the argument, Ehrnreiter threatened to knock her to the ground, beat her to death and “eat her face off” in front of the children, according to the complaint.

Police found three handguns, a shotgun and a 30-06 rifle inside Ehrnreiter’s home. Both long guns were loaded and were in an unlocked closet; a loaded .40-caliber handgun was found in a dish in an unlocked laundry-room cabinet, according to the complaint.

Police were called to the second incident just before 1:30 a.m. Jan. 1 after someone reported that an intoxicated man had threatened partygoers with a gun.

When officers arrived, a woman told them that she and others had wrested the gun away from Hermanowski, and he had run into his house next door. Police surrounded the home and contacted him via cell phone, and he eventually emerged, yelling and crying, telling officers that he was suicidal and wanted to go to the VA Medical Center.

Hermanowski’s girlfriend told police that they had invited several people to their home for a New Year’s Eve party that eventually moved next door. She said Hermanowski made “condescending remarks” to her because she refused to do a shot of alcohol; another woman intervened, and Hermanowski left the party, returning a short time afterward.

He was talking to a woman about martial arts when he suddenly pulled a gun “out of nowhere” and began to yell, pointing it directly at his girlfriend and her son, according to the complaint. The woman told police that she sent her son to the basement and hid under a table as the other woman struggled with Hermanowski and wrenched the gun away from him.

The victim told police that Hermanowski had bought the gun on Dec. 31, and that she was afraid he was going to kill her.

Witnesses told police that Hermanowski and the victim had been “bickering” all night, and when he returned to the party after briefly going home, he pointed a handgun at her, yelling at everyone to get on the ground because “this is real.”

One witness said she tried to call 911 during the confrontation, but Hermanowski ripped the phone out of the wall.

Hermanowski was arrested and later told police that the victim had punched him in the mouth “out of the blue,” according to the complaint. He said he collected the gun and came back to the party because he wanted to be ready for “whatever situation presented itself,” the complaint says.

Hermanowski said he was attacked by three or four people, who punched him and put him in a chokehold, at which point he grabbed the gun and pointed it at the kitchen, ordering everyone to the ground, according to the complaint.

He said partygoers continued to struggle with him, and after the gun was knocked from his hand, he went home, barricading himself inside “as he was trained to do,” the complaint says. He claimed to be a military veteran and a member of the Minnesota National Guard.

Ehrnreiter has been released from custody on a $50,000 bond, and was ordered to stay away from the victim’s residence. An omnibus hearing in his case is scheduled April 8 in Dakota County District Court in Hastings.

Hermanowski was released from custody on a promise to make all future court appearances, and was also ordered to stay away from the victim’s home. His omnibus hearing is scheduled Jan. 28, also in Hastings.


Rosemount Man Sentenced to 60 Days in Hit-And-Run Death of Apple Valley Woman

A Rosemount man was sentenced to 60 days in jail in connection with a 2009 fatal hit-and-run in Apple Valley.

Eric James Hunter, 44, struck Joan LeVasseur, 26, of Apple Valley, with his car on March 6, 2009. She died a week later.

Hunter was also sentenced to three years probation and will be ordered to pay restitution to the victim’s family, according to a news release from the office of  Dakota County Attorney James Backstrom.

Hunter was tried on two counts: leaving the scene of a fatal accident and driving with a suspended license. He originally was tried two years ago, but the the jury was unable to reach a verdict.

Here is the full text of the news release:

Dakota County Attorney James Backstrom announced that Eric James Hunter, age 44 of Rosemount, was sentenced today by Judge David Knutson to 60 days in jail, 30 days of Sentence-to-Serve and probation for three years in connection with leaving the scene after hitting 26-year-old Joan LeVasseur, of Apple Valley, on March 6, 2009. LeVasseur later died from her injuries. The Defendant is also ordered to pay restitution in an amount to be determined. Judge Knutson stayed the execution of 13 months in prison which Hunter faces if he violates his probation.

Backstrom stated that around 9:00 p.m. on March 6, 2009, Ms. LeVasseur was crossing the intersection of Cedar and 153rd Street in Apple Valley when Hunter struck her. He then drove away and did not notify authorities. Police continued to investigate this incident based on witness descriptions. It wasn’t until March 11th that the Apple Valley Police were told about Eric James Hunter. Minnesota law makes it a felony if someone involved in a motor vehicle accident resulting in personal injury or death (who does not cause the accident) flees the scene or fails to immediately contact the police. If someone who causes a motor vehicle accident resulting in death flees the scene, the crime of Criminal Vehicular Homicide is committed. However, based upon the accident reconstruction completed in this instance, the accident appears to have been caused by the victim crossing the street against a red light in the dark. Backstrom noted that pedestrians in Minnesota who cross a street at a signal-controlled intersection must obey the traffic signals.

In October of 2010 a Dakota County Jury heard testimony for approximately five days and deliberated for multiple days before Judge David Knutson declared a hung jury. The Defendant appealed the court’s decision claiming the case could not be retried on double jeopardy grounds. The Court of Appeals concluded that the case could be retried. At his re-trial date of October 22, 2012, the Defendant pled guilty to one count of Leaving the Scene of an Accident Involving a Death (a felony).

Backstrom expressed his sympathy to the family and friends of Joan LeVasseur for their great loss. Backstrom praised Assistant County Attorney Kevin Golden who prosecuted the case. Backstrom thanked the Apple Valley Police Department and the Minnesota State Patrol for their thorough investigation in this matter.

    Students who maintain a 4.000 grade point average (GPA) on a 4.000 scale are named Scholars of Distinction; students who achieve 3.6667 or above earn High Honors; and students who maintain a GPA of 3.2000 receive Honors.

      Council Preview: Athletic Fields at Erickson Park, Private Banners on Public Light Poles?

      The Rosemount City Council will convene at 6:30 p.m. today at the Rosemount City Hall to hold a council worksession. Here's a preview of a selection of agenda items the council is expected to discuss. For a full agenda, click here.

      • Rosemount High School Athletic Director Michael Manning is worried about losing the athletic fields at Erickson Park in Rosemount due to the proposed construction of several tennis courts at the site. Although the city plans to build additional fields at Flint Hills Park, Manning believes the distance from the park to the high school makes using those proposed fields impractical for high school use. Manning has presented five alternatives to the council and is expected to speak about his concerns at the session.
      • Rosemount organizations wanting to publicize a community-wide event could soon have another advertising outlet—banners on light poles in the city. The council is expected to discuss allowing private organizations to place banners on 145th Street and Hwy. 3—and the possibility of underwriting all or a portion of the cost for banners where the organization has a relationship with the city and delivers a community-wide event.
      • The city, along with a handful of other area communities, is participating in the Robert Street Transitway Alternatives Analysis to determine the appropriate route and mode of public transit between downtown St. Paul and Rosemount. The council is expected to review preliminary design alternatives for the transitway today.
      • Finally, the Rosemount City Council is expected to hold a 2013 goal-setting discussion Jan. 25 and 26. The council will likely review a draft agenda for the goal-setting session today.

      Editor's Note: The following is a news release from Dakota County.

      You can help shape the future of two greenway corridors in Dakota County—the Lake Marion-South Creek Greenway and the Mendota–Lebanon Hills Greenway—by attending an open house to review and comment on the plans. The open houses are part of the year-long master planning process for the two greenways.  

      The open houses are scheduled from 6 to 8 p.m. Tuesday, Jan. 15 at the Lebanon Hills Regional Park Visitor Center, 860 Cliff Road, Eagan and 6 to 8 p.m. Thursday, Jan. 24,  at the Lakeville Water Treatment Facility, 18400 Ipava Ave., Lakeville. Review and provide feedback to the planning team on alignment alternatives, design character, trailheads, habitat restoration, interpretive themes and more. The information for both greenway corridors will be presented at each open house.  

      The Lake Marion-South Creek Greenway travels 18 miles from the Minnesota River in Burnsville to Lake Marion in Lakeville and on to Rambling River Park in Farmington. The Mendota-Lebanon Hills Greenway travels 11 miles from the Village at Mendota Heights through the communities of Mendota Heights, Inver Grove Heights and Eagan to Lebanon Hills Regional Park.  

      Dakota County is leading a national movement to transform simple trails into multi-functional corridors that provide recreation, non-motorized transportation, habitat value and water quality improvement. The two greenways are part of the planned 200 mile county-wide greenway network. Transforming trails into multi-functional greenways will demand innovative approaches to issues including road and rail crossings and working with private property owners.  

      “The county has made a lot of progress in both greenway construction and planning for new greenway corridors over the last 5 years. Resident input during the planning process helps us ensure that greenways, when constructed, are assets to the communities in Dakota County,” said John Mertens, project manager for Dakota County.       Where to Get the Flu Vaccine in Apple Valley-Rosemount

      Eight employees at Indiana University Health Goshen Hospital were recently fired after refusing to participate in a mandatory vaccination program.

       

      This year's strain of flu is turning out to be particularly nasty—and pervasive. But if you haven't yet fallen ill, it's not too late for preventive measures.

      Cases of influenza, some of them severe, have reached the "intense" level in Minnesota, and Dakota County is no exception.

      Since the start of the influenza season, 578 people have been hospitalized with laboratory-confirmed influenza, according to the Minnesota Department of Public Health reports for the 2012-2013 season. This is up from only 30 people who were reportedly hospitalized for the flu in a report from last month. 

      Tony Taschner, the spokesman for District 196, said that as of Friday, two area schools—Black Hawk Middle School in Eagan and Diamond Path Elementary in Apple Valley—had reached the point where the Minnesota Department of Health requires notification. 

      That happens when flu-like symptoms are reported in at least 5 percent of the student body, or by at least three students in any single class. Taschner said that to the best of his recollection, it's the first time any school in the district had reached that level since the swine flu scare of 2009.

      Burnsville Patch reported earlier today that space is scarce at Fairview Ridges, at least in part because patients with severe flu symptoms are filling hospital beds in the emergency room.

      The 150-bed hospital is a regional hub for the south metro.

      "We have been at or near our bed capacity for a few weeks now, since the flu surge started around Christmas and it's continued," said Carol Koeppel-Olson, an RN and the vice president of patient care services and chief nursing officer at Fairview Ridges. "I don't think we have peaked yet."

      Ricky Flatz, director of Urgent Care and Occupational Medicine for Health Partners, which operates the Apple Valley Urgent Care and Quick Clinic, said volumes of calls and patient visits are up 20-50 percent over typical levels at this time of year.

      Flu is responsible for almost all the increase, though not everyone calling actually has the flu, Flatz noted: Some people "want to come in and get the flu shot ... or get advice on what to do."

      All but a handful of U.S. states have reported a dramatic increase in flu-related illnesses. At least five Minnesotans have died, including two otherwise healthy teens: Max Schwolert, 17, and Carly Christenson, a 14-year-old St. Louis Park girl who died Tuesday.

      At this time last year, flu cases as a percentage of Minnesota's population were far lower than they are now, according to data on Google's Flu Trends. (Data specific to Apple Valley and Rosemount are not available on Flu Trends, but flu cases in the Twin Cities metro are in line with the state as a whole.)

      Overall in Minnesota, activity is categorized as "intense," while it was categorized as "low" at this time in 2011, according to Flu Trends.

      State: Think Twice Before Going Out on the Ice

      Ice fishing is a winter tradition for many Minnesotans.

       

      With several days of temperatures hovering at or above the freezing point, the Minnesota Department of Natural Resources (DNR) is reminding everyone not to let their guard down when traveling out on a frozen lake, river or pond.

      With days of warmer than normal temperatures, it doesn’t take long to make the ice brittle, said Kara Owens, DNR boat and water safety specialist: “Anglers or snowmobilers might be safe in one spot one day, but might fall through in the same place the very next day."

      So far this winter, there have been no ice-related deaths in Minnesota. Last winter, four people died after falling through the ice. As winter screeched to a halt, Hennepin County Sheriff Rich Stanek ordered all vehicles off the ice after a string of accidents and widespread reports surfaced of unsafe ice on Lake Minnetonka and other bodies of water. 

      “We want people to get out and enjoy our weather, but remember ice is never 100 percent safe,” she said. “Don’t put yourself or someone else in danger by going out on thin ice. No fish is worth your life.”

      DNR clear ice minimum thickness recommendations are:

      •  4 inches for walking.
      •  5 inches for a snowmobile or ATV.
      •  8-12 inches for a car. 
      •  12-15 inches for a medium-sized truck.

      No ice should ever be considered completely safe.

      Owens added when the temperature rises above freezing for six hours during a 24 hour period, people should double the recommended minimum thicknesses. If temperatures rise above freezing for 24 hours or more, they should stay off the ice.

      Owens recommends anyone heading out on the ice should: wear a life jacket, carry a set of ice picks, check with a local bait shop or resort— ask about ice conditions— and measure the ice.
